The b2bnetwork.pl website is operated by B2B.net S.A. with its registered office in 02-486 Warsaw, at Al. Jerozolimskie 172, entered into the Register of Entrepreneurs kept by the District Court in Olsztyn, VIII Commercial Department of the National Court Register, under number 0000387063, NIP: 5711707392, hereinafter referred to as “B2Bnetwork”.
The regulations specify the rules related to the purchase, organization and participation in training courses organized by B2Bnetwork.
THE DEFINITIONS USED IN THE RULES OF PROCEDURE MEAN:
User – a consumer, an entrepreneur and any other entity using the service, who has bought a training or other similar project organized by B2Bnetwork and/or subscribed to a newsletter.
Consumer – a User who is a natural person who performs legal actions from B2Bnetwork that are not directly related to his business or professional activity.
Participant – User and/or other person designated by the User to participate in the Training.
Training – educational activities taking place in the form of workshops or lectures, either in classroom or online, aimed at obtaining, supplementing or improving professional qualifications. The date and subject of the training each time is specified in detail in the information about the training.
Order – a training order form completed by the User and sent to B2Bnetwork in order to purchase training or to purchase training online.
Contract – a contract of sale of the Training concluded between B2Bnetwork and the User, according to the content of the submitted Order.
Coordinators – a person appointed by B2Bnetwork to serve User.
Trainers – persons conducting training on behalf of B2Bnetwork.
Newsletter – a free B2Bnetwork newsletter containing, in particular, information about organised trainings, workshops, webinars and meetings, which can be received after subscribing to it via the www.b2bnetwork.pl website and agreeing to receive commercial information by e-mail.
RODO – Regulation 2016/679 of the European Parliament and Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) of 27 April 2016. (OJ EU.L No. 119, p. 1).
CONCLUSION OF CONTRACT
The information on the www.b2bnetwork.pl website does not constitute an offer within the meaning of Article 66 of the Civil Code. When placing an Order via the form, the User makes an offer to purchase a specific Training, under the conditions specified in the information about this Training.
In order to place an Order, the User makes an online application via the form available at www.b2bnetwork.pl, which is sent to B2Bnetwork.
The conclusion of the Training Contract between B2Bnetwork and the User takes place at the moment when B2Bnetwork provides an e-mail confirming acceptance of the Order and participation in the Training.
The condition for concluding the Training Contract is acceptance of the terms of the Regulations.
Participants who are under 18 years of age or do not have full legal capacity may take part in training courses organised by B2Bnetwork only with the written consent of their parents or legal guardians.
By concluding the Agreement, the User is obliged to pay the remuneration for the Training.
B2Bnetwork has the right to refuse User and/or the Participant designated by him/her to participate in the Training if he/she fails to pay the remuneration.
User can make payment by online transfer.
At the request of the User it is possible to issue a pro-forma invoice.
The VAT invoice is issued immediately after the Training and sent to the User to the e-mail address indicated in the application.
The User agrees to send invoices, duplicate invoices and correction invoices by e-mail to the e-mail address provided by the User in the Order. If the e-mail address referred to in the previous sentence is changed, the User is obliged to notify B2Bnetwork in writing, with the reservation of section 7.
The documents referred to in section 6 may be sent to the User in paper form, when technical obstacles make it impossible to send them by electronic means.
RESIGNATION FROM PARTICIPATION IN THE TRAINING (WITHDRAWAL FROM THE CONTRACT) – CONSUMER.
The Consumer has the right to withdraw from the Contract without giving any reason and at no cost, within 14 days of its conclusion. The Consumer loses the right to withdraw from the Contract if he took part in the Training which took place before the end of the period referred to in the first sentence, with his expressed consent.
In order to exercise the right under section 1, the Consumer submits a statement of withdrawal from the Order by sending the statement to the following e-mail address: firstname.lastname@example.org or directly to the Coordinators.
B2Bnetwork will immediately, but not later than within 14 calendar days from the date of receiving the statement of withdrawal from the Contract, return all payments made by the Consumer.
In the case of a statement by the Consumer that it is his/her willingness to use the paid funds to participate in the same training, at another possible date or to participate in another training of his/her choice, B2Bnetwork will credit the payment on account of remuneration for the new training selected by the Consumer.
B2Bnetwork will refund the payment using the same payment method used by the Consumer.
RESIGNATION FROM PARTICIPATION IN THE TRAINING (WITHDRAWAL FROM THE CONTRACT) – OTHER USERS.
In the event of withdrawal from the Contract by Users who are not Consumers, the relevant provisions of § 5 apply, subject to the following points.
B2Bnetwork will immediately, but not later than within 14 calendar days from the date of receiving the statement of withdrawal from the Contract, return the remuneration paid by the User for the Training, after deducting the administrative and accounting costs amounting to 1% of the amount paid.
If it is necessary to issue a correcting invoice, the time for the reimbursement of the amount (14 days) is counted from the time of confirmation of acceptance of the correcting invoice by the User. The confirmation can be made by e-mail.
In case of cancellation of the training by the Participant later than 14 days before the date of the beginning of the training (the date of receiving the cancellation by e-mail to B2Bnetwork) or not taking part in the training, B2Bnetwork retains the right to full remuneration for the Training.
B2Bnetwork has the right not to conclude the Contract with the User or to withdraw from the Contract in any case of non-payment by the User of remuneration to B2Bnetwork, resulting also from titles other than Training.
CHANGES IN TRAINING.
In the case of a change in the place (city) or date of training, B2Bnetwork is obliged to immediately inform the User about these changes and if the User does not accept the changes, B2Bnetwork is obliged to establish a convenient solution for both parties (including: transferring the User to another date of training or another place of training or reimbursement of payment).
B2Bnetwork has the right to change the Trainer if this is due to reasons beyond its control.
B2Bnetwork has the right to withdraw from the Contract concluded with the User, at the latest 4 working days before the planned date of the Training, in case of lack of sufficient number of Participants and in other random cases. In the above situation, the User may demand a refund of the paid remuneration or declare that he wants to use the paid amount of money for the same training held on a different date. In the case of a demand for a refund, the User shall be reimbursed the entire amount initially paid by him within 14 days.
The User will be informed about the changes referred to in § 7 of the Regulations by e-mail no later than 4 days before the planned date of training.
LIABILITY AND WARRANTIES B2Bnetwork
B2Bnetwork guarantees the employment of suitable Trainers to carry out the Training.
B2Bnetwork as well as Trainers and Coordinators are in no way responsible for the form and effects of the Participant’s use of the methods, products and services obtained during the training.
In case of repeated reprehensible behaviour of the Participant during the training, the Trainer or Coordinator has the right to order the Participant to leave the training. In this case the Participant is not entitled to a refund of the amount paid for participation in the training.
Trainers and Coordinators shall not be liable for damage caused by the Participant at the place of training.
B2Bnetwork shall inform Users of any changes to the Terms and Conditions by posting the relevant information on its website.
In matters not regulated by the Regulations, the provisions of the Civil Code shall apply, and the Act of 30 May 2014 on Consumer Rights shall also apply to Consumers.
